Senaira Terms of Service

Welcome to Senaira. These Terms of Service ("Terms") govern your access to and use of [senaira.com] (the "Site") and any purchase you make through it. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Senaira is operated from New Zealand. Our products are shipped from a fulfilment partner based in the United States.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on the Site. By using the Site, you confirm that you meet this requirement.

2. Products and Pricing

We aim to display product information, images and pricing accurately. However:

• Colours and appearance may vary slightly depending on your screen.
• We reserve the right to correct pricing or listing errors, cancel affected orders, and refund any payment already made.
• Prices are subject to change without notice, though this will not affect orders already confirmed.
• Product availability is not guaranteed until your order is confirmed.

3. Orders and Payment

By placing an order, you're making an offer to purchase, which we may accept or decline (for example, due to stock issues, suspected fraud, or a pricing error). Payment is processed securely at checkout. We reserve the right to cancel or refuse any order at our discretion.

4. Shipping

They are not medical devices and are not intended to diagnose, treat, cure or prevent any medical condition or disease. Product descriptions and marketing content are provided for general informational purposes only and are not a substitute for professional medical advice.

7. Acceptable Use

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorised access to the Site, our systems, or other users' accounts
• Interfere with or disrupt the Site's functionality or security
• Use automated tools to scrape, copy or extract content from the Site without permission
• Submit false, fraudulent or misleading information, including for orders or payments

We may suspend or terminate access to the Site for anyone who violates these Terms.

8. Intellectual Property

All content on the Site — including the Senaira name, logo, product photography, graphics, text and design — is owned by or licensed to Senaira and protected by intellectual property law. You may not reproduce, distribute or use this content for commercial purposes without our written permission.

9. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, accuracy or practices of any third-party sites, and including a link does not imply endorsement.

10. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, Senaira is not liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products purchased through it. Our total liability for any claim relating to a purchase is limited to the amount you paid for the product in question.

Nothing in these Terms limits any right that cannot be excluded under applicable consumer protection law.

12. Indemnification

You agree to indemnify and hold Senaira harmless from any claims, damages, losses or expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Site.

13. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute, claim or controversy arising out of or relating to these Terms, the Site, or any product purchased through Senaira will first be addressed through good-faith negotiation. If a dispute cannot be resolved this way, it will be resolved by binding individual arbitration under the Arbitration Act 1996 (New Zealand), rather than through court litigation, except that either party may bring a qualifying individual claim through a small-value consumer dispute process available in their own jurisdiction.

• No class or representative actions. You and Senaira agree that any dispute will be brought only in an individual capacity, and not as a plaintiff or member in any class, collective or representative proceeding.
• Arbitration will be conducted on an individual basis, with the seat of arbitration in New Zealand, unless both parties agree otherwise in writing.
• This section does not prevent either party from seeking injunctive relief in court for intellectual property infringement or unauthorised use of the Site.

If any part of this clause is found unenforceable, the remainder will still apply to the fullest extent possible. Nothing in this section limits any right you have under mandatory consumer protection law that cannot be waived by agreement.

14. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles, and the courts of New Zealand will have non-exclusive jurisdiction over any matter not resolved through the process above.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
